Terms of Service

1. Introduction

Welcome to SprintRhythm-for-Jira ("we", "us", "our"). By accessing or using our Jira addon ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Service Description

Our Service, SprintRhythm-for-Jira, is the ultimate tool for a development team. It was created to help team leaders have better control over their sprint by providing crucial data at every step. The service facilitates efficient task allocation and promotes learning from each sprint, with the goal of achieving a state where all sprint tasks are completed within the sprint's boundaries, eliminating delays and improving team velocity.

To provide these features, the Service accesses data from your Jira instance and stores related metrics using Atlassian's Forge storage, which means we do not have direct access to the stored data. The accessed and stored data includes:

  • Jira Boards, Sprints, and Issues: To determine active sprints, manage issues, and perform calculations for dashboards (e.g., Burndown charts, bug tracking).
  • Jira Groups/Teams: To help team leaders manage team composition for capacity planning.
  • Stored Data (via Forge Storage):
    • Settings: Configuration data per team, such as work schedules, issue types for capacity measurement, and bug type definitions.
    • Capacity Data: Daily capacity, days off for team members, and team-wide days off.
    • Performance Metrics: Daily snapshots of remaining effort for sprint burndown, lists of issues added mid-sprint for scope change tracking, and effort estimates from team members during estimation poker sessions.

3. User Responsibilities

You agree not to misuse the Service. Misuse includes, but is not limited to:

  • Using the service for any illegal purpose or in violation of any local, state, national, or international law.
  • Attempting to reverse engineer, decompile, hack, disable, interfere with, disassemble, copy, or disrupt the integrity or performance of the Service.
  • Providing false or inaccurate information when configuring the Service.

4. Payment and Refunds

The Service is offered on a subscription basis, billed monthly or annually. The fee is based on your Atlassian Jira site's user count, not the number of individuals who use the Service. Refund policies are in accordance with the Atlassian Marketplace Terms of Use. Generally, a 30-day refund period from the date of purchase is available.

5. Termination

You can terminate your subscription at any time by uninstalling the app from your Jira instance, in accordance with Atlassian Marketplace policies. We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Intellectual Property

You retain full ownership of your data within your Jira instance. You also retain full ownership of any data generated by the Service that is derived from your Jira data (e.g., capacity plans, performance metrics). We claim no intellectual property rights over your data or the content generated by the Service based on your data.

7. Disclaimer of Warranties; Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, timely, secure, or error-free. We will provide support to ensure the Service performs its intended functions as described. In no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes in accordance with Atlassian Marketplace standards, which may include posting a notice within the Service or sending an email.
